The Baker Act is an existing law that provides for temporary institutionalization of individuals who meet certain criteria. As a result, people cannot be involuntarily institutionalized simply because they're acting strangely, refuse to seek psychiatric examinations, or have occasional mood swings or outbursts.
Why is it called a Baker Act? The legislation was nicknamed the "Baker Act" after Florida Democratic state representative from Miami, Maxine Baker, who served from 1963 to 1972. She had astrong interest in mental health issues, served as chair of the House Committee on Mental Health, and was the sponsor of the bill.
Can police Baker Act you? The Baker Act empowers law enforcement officers to initiate an involuntary evaluation of someone if they exhibit any of the following conditions: They are mentally ill. They are either a danger to themselves or to others. Without treatment, they are likely to suffer from_neglect.
Are psych wards free? The cost of mental health services varies enormously, depending on where you live and what service you are getting. If you see a doctor (GP or psychiatrist), Medicare covers some orall of that cost. If you are in a public hospital, care is free.
Who can request a mental health act assessment? Anyone can request a mental health assessment by contacting your local social services or community mental health team.
